Homebodies Notice to Customer
Homebodies is a registered business in the City of San Jose, and as such meets all relevant obligations.
Homebodies operates within CA state law as an unlicensed and uninsured home repair contractor to make repairs up to $500 per project.
On projects exceeding $500, the customer must assume the role of owner/builder, and are legally responsible for ensuring quality and professional work. As your subcontractor, Homebodies is in every respect obligated to inform and advise you in good faith about the best available solutions and materials.
I promise to operate with complete transparency regarding the solutions and materials used in any repairs in any hidden areas. I will advise you of any conditions related to my own repairs that are intended as temporary, are less than optimal, or are substandard or unsafe due to extenuating circumstances.
I promise to return and fix any structures or systems that fail due to faulty installation or workmanship for up to 10 years. However, I will not assume responsibility for customer supplied components, used components, manufacturer’s defects, or the work of other contractors.
I do myutmost to warn customers about the pitfalls and hazards of any job I undertake prior to getting started, or as soon as a situation warranting concern arises. And of course, I promises to fix, at no additional cost to the customer, any mistake or damage we might cause.
However, there is never any guarantee against damage due to unforeseen hazards.
Anything can happen.
Most of the time, unforeseen hazards are due to violations of building codes and preexisting defects in materials or workmanship. For example, driving a screw into a stud could result in a burst pipe if the pipe was not properly protected with a nail protection plate. Or, pressure plunging a drain could result in a burst pipe if the pipe was not properly installed, or is substantially degraded.
In the event of damage resulting from unforeseen hazards:
- All improvements and repairs made to that point due and payable to me regardless of the consequential damages that resulted from the unforeseen hazard.
- I promise to restore the property to a clean, livable, serviceable condition as quickly as possible. From there, it will be up to you the customer to contract with Homebodies for any additional repairs.
If you want a replacement contractor to take over the job, I will assist you in finding a replacement contractor and will continue working at the same labor rate until transfer of the job to the replacement contractor is complete.
I guarantee your satisfaction and I’ll do everything I reasonably can to fulfill my promise.
